Estate Planning:  Getting Started
 

Living Trusts, Pour-over Wills and Powers of Attorney for HealthEstate planning is a process involving the services of a lawyer who listens to your goals and concerns and then assists with planning your estate in order to provide protection for your family. 

Estate planning covers the transfer of property at death as well as a variety of other objectives which may or may not involve tax planning.  The core document most often associated with this process is the Will or Living Trust. 

What is a Living Trust?

The popularity of executing a Living Trust has replaced the traditional Will for most families.  The advantages of avoiding Probate and avoiding potential Guardianship proceedings are the incentives for families to undertake this form of estate planning.  A surviving spouse and the heirs will have immediate access to a family's assets upon a spouse's death which is a practical approach for family finances.  

Trusts are not only for the wealthy.  Many young parents with limited assets choose to create trusts during their lifetime for the benefit of their children in case both parents die before all their children have reached an age deemed by them to indicate sufficient maturity to handle property.
